Terms of Service

1. Acceptance of Terms

By creating an account or using Data Magpie (operated by Mastrotunes, "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use the service.

2. The Service

Data Magpie is a personal data marketplace. Users ("Sellers") can connect third-party data sources (banking, music streaming, etc.), build an encrypted data vault, receive purchase offers from verified businesses ("Buyers"), and earn money by approving data sales. Sellers keep 80% of each transaction; Data Magpie retains a 20% platform fee.

3. Eligibility

• You must be at least 18 years old to use Data Magpie.
• You must be a human individual — no bots, automated accounts, or fictitious personas.
• You must have the legal right to sell the data you connect to your vault.
• Buyers must be verified businesses and agree to separate Buyer Terms.

4. Your Data & Vault

• You own your data. We do not claim any rights to the data stored in your vault.
• You are responsible for ensuring you have the right to share any data you connect.
• You control every data sale — no data is released to a buyer without your explicit approval.
• You may disconnect any data source or delete your vault at any time.
• Once a sale is approved and data is released to a buyer, that specific transaction cannot be reversed.

5. Payments & Fees

• All payments are processed through Stripe Connect.
• Sellers receive 80% of the gross transaction amount. The 20% platform fee is non-refundable.
• Funds are released to your Stripe account after the buyer's payment clears and you approve the data release.
• You are responsible for any taxes on your earnings. Data Magpie does not withhold taxes.
• Minimum payout thresholds and processing times are subject to Stripe's terms.

6. Prohibited Uses

You may not:

• Submit false, misleading, or fabricated data to your vault.
• Connect data sources you do not own or have permission to share.
• Attempt to circumvent encryption, security controls, or the approval flow.
• Use the platform for any unlawful purpose.
• Impersonate another person or entity.
• Attempt to reverse-engineer the platform.

7. Third-Party Services

The platform integrates with Plaid, Spotify, Google, and Stripe. Your use of those services is governed by their respective terms and privacy policies. Data Magpie is not responsible for outages, policy changes, or data issues originating from those providers.

8. Termination

We may suspend or terminate your account for violation of these terms, fraudulent activity, or any other reason we deem necessary to protect the platform or other users. You may delete your account at any time by contacting michaelrmastronardi@gmail.com.

9. Disclaimers

Data Magpie is provided "as is" without warranties of any kind. We do not guarantee that buyers will purchase your data, that any specific earnings will be achieved, or that the platform will be available without interruption.

10. Limitation of Liability

To the maximum extent permitted by law, Mastrotunes shall not be liable for indirect, incidental, special, or consequential damages arising out of your use of the platform, including lost earnings or data loss.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Orange County, California.

12. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
